No Grace Period: Europe’s New Packaging Mandate

A sweeping overhaul of European packaging law is weeks away. On August 12, 2026, the EU Packaging and Packaging Waste Regulation takes full application, replacing Directive 94/62/EC. The rules impose demanding standards on businesses operating across EU markets. No grace period exists for existing stock, meaning any non-compliant packaging placed on the market after that date violates the regulation outright.

Mandatory PFAS restrictions in food-contact packaging stand out among its sharpest provisions. Limits are set at 25 parts per billion for individual compounds and 250 parts per billion for total content. Every company across food production, retail, and e-commerce must verify that supply chains meet these thresholds before the deadline arrives.

The regulation reaches beyond chemical safety to impose new recyclability, reuse, and extended producer responsibility obligations. Enforcement applies uniformly across all 27 EU member states. A non-compliant package sold in Warsaw carries the same legal exposure as one sold in Madrid. Multinational operators face immediate compliance obligations rather than a phased transition, which has caught some businesses off guard.

Preparation began following detailed European Commission guidance published on March 29, 2026. The publication left companies with a tight four-month window to close remaining compliance gaps. Supply chain audits, material reformulations, and updated producer responsibility registrations are now underway across multiple industries.

Early action reduces legal risks and exposure to supply disruption. While consumers will eventually see safer materials on shelves, businesses that delay face immediate enforcement pressure. The regulatory window is closing.
